General Terms and Conditions (GTC) – SpyLicht.de
1. Scope
These GTC apply to all orders placed via our online shop spylicht.de. Any deviating terms and conditions of the customer shall not apply unless we expressly agree to them in writing.
2. Contractual partner, conclusion of contract
The contractual partner is Adrian Cindescu – Gewerbe (sole proprietorship), Werderstr. 16, 68165 Mannheim, Germany.
The presentation of the products in the shop does not constitute a legally binding offer, but rather a non-binding invitation to place an order. A contract is concluded as soon as we confirm the order by email or deliver the goods.
3. Prices, shipping costs
All prices are quoted in euros. Due to the application of the small business regulation in accordance with § 19 UStG, no sales tax is shown.
The shipping costs are shown separately in the order process (checkout).
4. Payment
The payment methods displayed at checkout are available. We reserve the right to exclude individual payment methods.
5. Delivery
Deliveries are made exclusively to the countries specified at checkout. Delivery times are also displayed there. In the event of force majeure, delivery times shall be extended accordingly.
6. Retention of title
The goods remain our property until full payment has been received.
7. Right of withdrawal
Consumers are entitled to the statutory right of withdrawal as described in our cancellation policy.
There is no right of withdrawal for customized products or products manufactured to customer specifications.
8. Warranty
The statutory rights in respect of defects apply. For business customers (B2B), the obligation to inspect and give notice of defects pursuant to Section 377 of the German Commercial Code (HGB) applies.
9. Liability
We are liable without limitation for intent and gross negligence as well as for damages resulting from injury to life, limb, or health.
In cases of slight negligence, we are only liable for the breach of essential contractual obligations (cardinal obligations), limited to the foreseeable, typical damage.
10. Dispute resolution
The EU Commission provides a platform for online dispute resolution (ODR):

We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
11. Final provisions
German law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).
For consumers, this choice of law applies only insofar as it does not deprive them of the protection afforded by mandatory provisions of the state in which the consumer has their habitual residence.
The place of jurisdiction for merchants is Mannheim, Germany.
